Do I Need a Spanish Solicitor to Buy Property?

Do I Need a Spanish Solicitor to Buy Property?

Technically, Spanish law does not force you to hire a solicitor to buy a home. You can complete a purchase without one, but doing so as an overseas buyer is a massive risk that leaves you completely exposed to hidden costs and legal traps.

The Big Trap: Spanish Notaries Are Neutral

The biggest mistake UK buyers make is assuming the Spanish notary (Notario) is looking out for them. In Spain, a notary is simply an impartial government official. Their job is just to witness the final paperwork, verify identities, and ensure the state collects its taxes. They will not check if the house was built illegally, whether there is a massive unpaid mortgage attached to it, or if the seller actually owns the land. That falls entirely on you. The Spanish Notarial Council also explains that notaries carry out important checks relating to ownership, charges and the property’s registration before and after a sale.

Understanding the role of a Spanish notary before you sign can help you distinguish the notary’s responsibilities from the independent legal advice provided by your own lawyer.

What an Independent Solicitor Protects You From

In Spain, outstanding debts stick to the property, not the person who ran them up. If the previous owner stopped paying their mortgage, local council taxes, or utility bills, those debts become your problem the second you buy the place.

An independent solicitor (abogado) does the vital detective work before you part with any deposit money, including:

Checking for hidden debts – They search the property registry to ensure the title is free of outstanding mortgages, unpaid taxes, or community maintenance fees. The Spanish Government recommends checking the property’s legal status, ownership and charges through the Property Register before buying.

Confirming planning permission – They verify that extensions, swimming pools. Or the entire building were constructed legally with full local authority licenses.

Handling local paperwork – They set up your mandatory Spanish tax number (NIE), open a local bank account, and handle the property transfer tax payments.

Just make sure you choose your own lawyer, never use one recommended directly by the seller or the estate agent, trying to close the deal.
